Lawful Presence Verification

Georgia law (O.C.G.A. Section 50-36-1) requires all applicants for a public benefit to verify their lawful presence in the United States before receiving the benefit. A Bright from the Start license or registration is a public benefit issued to the owner of a child care facility each year. Therefore, Bright from the Start must have the required verification documents before the annual license will be issued.

New this year: A change in Georgia law states that any applicant for a license/registration or renewal who previously submitted verification of U.S. citizenship to Bright from the Start, is not required to re-submit verification. Those owners who are previously verified as U.S. citizens, do not have to re-submit lawful presence verification. Their previous verification of U.S. citizenship continues to meet the requirements of the law.

Below are instructions for you according to your child care program(s)’ ownership type:

  • Your child care program(s) are owned by a sole proprietor, one person. (This includes family day care homes.)
    1. If the owner previously submitted verification of U.S. citizenship to Bright from the Start, you do not have to submit verification of lawful presence because verification was completed last year.

    2. If the owner previously submitted verification of lawful presence as a permanent resident of the U.S. or as a legal alien in the U.S., you have to submit verification of lawful presence this year.

  • Your child care program(s) are owned by a corporation, partnership, limited liability company (LLC), or are board-sponsored.
    1. If the owner previously submitted verification of U.S. citizenship, the owner will be asked to affirm that the previously verified person remains the same or indicate if this has changed. This can be done on the on-line license fee payment screen for your child care program, or on the affirmation page Bright from the Start sent to child care programs via e-mail on November 1, 2013. After Bright from the Start confirms the information the license fee can be paid.

    2. If the owner previously submitted verification of lawful presence as a permanent resident of the U.S. or a legal alien in the U.S., the owner is required to submit verification of lawful presence this year.

  • If your child care program(s) are owned by a government entity such as a municipality, county or state agency, university or college, you do not have to meet this requirement of Georgia law.

If you’re required to submit verification of lawful presence this year, the director or administrator cannot complete the required documents unless that person is also an owner. License fees are due December 1, 2013

You will not be able to pay your license fee until the affidavit and secure and verifiable document are received, recorded, and eligibility has been verified. Bright from the Start staff will record receipt of the documents and verify eligibility. Please allow adequate time for your verification documents to be processed. You will be notified by e-mail when you can pay your license fee which you will be able to do online or by mail. You will receive your annual license or registration after your license fee has been paid.
